References to “we”, “us”, “our” refer to Spark Sylwia Rytarowska. References to “you”, “subscriber”, “user” refer to the person subscribing to the Newsletter.

2. Definitions

Newsletter: an electronic service consisting of sending commercial and informational messages to Subscribers by email, including content related to the Digital Mistress brand, products, services, events, and educational materials.

Subscription Form: an interactive form on the Website or a dedicated landing page through which a User signs up to receive the Newsletter.

Subscriber: a User who has actively signed up via the Subscription Form and confirmed their subscription (double opt-in).

Digital Content: any materials delivered in digital form, including lead magnets, guides, templates, or other resources provided in exchange for subscribing.

Website: the website available at digitalmistress.tech and all its subpages.

3. General Provisions

These Newsletter Terms set out the rules for subscribing to and using the Newsletter service, the terms for delivering digital content, and the complaint procedure.

The Newsletter service is intended for adults aged 18 and over. By subscribing, you confirm that you meet this requirement.

These Terms are made available free of charge on the Website and are provided to the User before subscription.

4. Technical Requirements

To use the Newsletter service, you need:

• a device with internet access and a working operating system (e.g. macOS, Windows, Android, iOS);

• an up-to-date web browser supporting HTML5 (e.g. Chrome, Firefox, Safari);

• an active email address.

We take appropriate technical and organisational measures to ensure the security of data transmitted through the Website, including SSL encryption.

5. Subscribing to the Newsletter

To subscribe to the Newsletter, you must:

• complete the Subscription Form by providing your first name and email address;

• confirm your subscription by clicking the confirmation link sent to your email (double opt-in).

By confirming your subscription, you agree to receive commercial and informational communications from us via email, and to the use of electronic communication devices for direct marketing purposes.

These consents are voluntary but required to receive the Newsletter. You may withdraw them at any time, which will result in termination of the Newsletter service.

The subscription contract is concluded at the moment of successful confirmation of the sign-up. You are required to provide accurate and truthful data when completing the Subscription Form.

6. Digital Content Delivered Upon Subscription

Where we offer digital content (such as a guide, checklist, template, or other resource) in exchange for subscribing to the Newsletter, the following applies:

By submitting the Subscription Form, you expressly request immediate delivery of the digital content before the expiry of the 14-day withdrawal period that applies under EU consumer law. By requesting immediate delivery, you acknowledge that you lose your right of withdrawal in respect of the digital content once delivery has commenced.

This does not affect your right to unsubscribe from the Newsletter at any time.

The digital content is protected by copyright and other intellectual property rights belonging to Spark Sylwia Rytarowska. You receive a personal, non-transferable licence to use the content for your own purposes. You may not reproduce, distribute, or resell the content without our prior written consent.

7. Unsubscribing

You may unsubscribe from the Newsletter at any time and without giving any reason by:

• clicking the “Unsubscribe” link in the footer of every Newsletter email;

Unsubscribing takes effect immediately and results in termination of the Newsletter service contract. We reserve the right to discontinue the Newsletter service at any time, with prior notice to Subscribers by email.

Your complaint should include your name and email address, a description of the issue, and your requested resolution. We will respond within 14 calendar days.

EU consumers may also use alternative dispute resolution mechanisms:

• Polish Trade Inspection (Inspekcja Handlowa) for mediation;

• District consumer ombudsman (rzecznik konsumentow).

9. Personal Data and Cookies

By subscribing to the Newsletter, you provide us with your personal data (name and email address). This data is processed in accordance with our Privacy Policy, available at digitalmistress.tech/privacy-policy

The Privacy Policy describes the legal bases for processing, retention periods, your rights under GDPR, and how to contact us regarding data protection matters.

10. Amendments to These Terms

We may update these Newsletter Terms from time to time for justified reasons, including changes in applicable law, changes to the Newsletter service, or the need to improve clarity.

We will notify Subscribers of any material changes via email at least 14 days before the changes take effect. If you do not accept the changes, you may unsubscribe before they apply. Continued use of the Newsletter after the effective date constitutes acceptance of the updated Terms.

11. Final Provisions

These Terms are governed by Polish law. For EU consumers, the application of mandatory consumer protection provisions of your country of habitual residence is not excluded.
