The terms “we”, “us”, “our” refer to Spark Sylwia Rytarowska. The terms “you”, “your”, “member” refer to the person purchasing access to the Service.
2. Service Description
Digital Mistress Operating System (DMOS) is a 12-week digital membership program delivered via an online platform. The Service includes access to video lessons, PDF resources, templates, scripts, weekly live implementation calls, and a private community group.
Access to the Service is provided immediately upon successful payment. The Service constitutes digital content within the meaning of applicable consumer protection law.
3. Subscription and Billing
Access to DMOS is provided on a monthly subscription basis at $99.00 USD per month (or equivalent in local currency as shown at checkout).
Your subscription begins on the date of your first payment. Your payment method will be charged automatically every 30 days until you cancel.
You will receive a receipt/invoice via email after each payment. Invoices are issued by Spark Sylwia Rytarowska and may include applicable VAT depending on your location.
We reserve the right to change the subscription price. You will be notified at least 30 days in advance of any price change. Continued use of the Service after the price change date constitutes acceptance of the new price.
4. Cancellation
You may cancel your subscription at any time from your account dashboard (My Account → Membership → Cancel). There are no cancellation fees and no minimum commitment period.
Upon cancellation, your access to the Service will continue until the end of the current billing period. You will not be charged for the following billing period.
We do not provide refunds for partially used billing periods, except as required by applicable law or as set out in Section 5 below.
5. Right of Withdrawal — EU Customers
If you are a consumer residing in the European Union, you normally have the right to withdraw from a distance contract within 14 days without giving any reason.
However, by checking the corresponding box during registration, you expressly request that performance of the contract begins immediately and that digital content is delivered to you before the 14-day withdrawal period expires. You acknowledge and agree that by doing so, you lose your right of withdrawal once access to the digital content has been granted.
This provision does not affect any other statutory rights you may have as a consumer under the law of your country of residence.
6. Refund Policy
Due to the digital nature of the Service and the immediate delivery of content upon purchase, all sales are final. We do not offer refunds once access has been granted, except:
(a) where required by applicable mandatory consumer protection law in your country of residence;
(b) in the event of a technical failure on our part that prevents you from accessing the Service and which we are unable to resolve within a reasonable time.
To request a refund in the above circumstances, contact us at hello@digitalmistress.tech within 14 days of the issue arising, with a description of the problem.
7. Access and Account
You are responsible for maintaining the confidentiality of your login credentials. You may not share your account or provide access to the Service to any third party.
We reserve the right to suspend or terminate your account if we reasonably believe you are sharing access, violating these Terms, or acting in a way that is harmful to other members or to us.
8. Intellectual Property
All content within Digital Mistress Operating System (DMOS) — including but not limited to videos, PDFs, templates, scripts, and frameworks — is the intellectual property of Spark Sylwia Rytarowska and is protected by copyright law.
You are granted a personal, non-transferable, non-exclusive licence to access and use the content for your own business purposes. You may not reproduce, distribute, resell, sublicense, or create derivative works from any content without our prior written consent.
9. Disclaimers and Limitation of Liability
The Service is provided for educational and informational purposes. Results may vary. We do not guarantee specific business outcomes, revenue, or client acquisition results as a result of using the Service.
To the maximum extent permitted by applicable law, our total liability to you in connection with the Service shall not exceed the total amount paid by you in the 3 months preceding the claim.
Nothing in these Terms limits or excludes our liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded or limited under applicable law.
10. Governing Law and Disputes
These Terms are governed by Polish law. For EU consumers, the application of mandatory consumer protection provisions of your country of habitual residence is not excluded.
Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of Poland. EU consumers may also use the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

11. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
